PROPOSED DISPOSALS BY AUCTION AND ASSOCIATED SURPLUS ASSET DECLARATIONS

3. APPROPRIATEION OF SCC LAND TO ADOPTED HIGHWAY, LAND AT LAKESIDE NURSERY & PRIMARY ACADEMY SCHOOL, MINDENHURST ROAD, DEEPCUT, SURREY pdf icon PDF 1 MB

This report seeks approval for the appropriation of Council owned land held for education purposes and  forming part of the new Lakeside Nursery & Primary Academy School in Deepcut, to become part of the adopted highway.

Decision:

The Cabinet Member agreed to appropriation of the SCC owned land as illustrated in purple at Annexe A from land held for education purposes to public highway upon the adoption of Bracken Hill.

3. DISPOSAL OF 16 BROOK HILL, OXTED, RH8 9LR pdf icon PDF 147 KB

This report seeks approval of the Cabinet Member for Property, Waste, and Infrastructure to the freehold disposal of 16 Brook Hill, Oxted, RH8 9LR following an open market campaign. The asset is offered with full vacant possession with Surrey County Council (The Council) accepting, as part of the transaction, a surrender of the current headlease held over the asset by Halsey Garton Residential Ltd (HGR).

 

A separate Part 2 report contains information which is exempt from Access to Information Requirements by virtue of Schedule 12A Local Government Act 1972, paragraph 3, “Information relating to the financial or business affairs of any particular person (including the authority holding that information”).

The Cabinet Member:

 

1.    Formally declared the asset surplus to operational requirements (in consultation with The Leader and Deputy Leader).

2.    Approved the sale of 16 Brook Hill, Oxted, RH8 9LR to the party, at the price and subject to the conditions, noted in the Part 2 report. The sale is conditional upon the simultaneous surrender of the headlease held over the asset by HGR which has been agreed by the HGR Board.

3.    Approved, in conjunction with the Leader, the acquisition of the leasehold interest held by HGR over the property at the premium noted in the Part 2 report. The premium for the surrender of HGR’s interest is payable by the Council from the gross receipt and it is noted there is debt aligned to this asset, with both parties bearing their own costs and appointments of their own professional team.

4.    Delegated authority to the Section 151 officer in consultation with the Director of Land and Property to finalise the transaction and enter into all associated legal agreements.

This report seeks approval of the Cabinet Member for Property, Waste, and Infrastructure to the freehold disposal of The Cottage (Old Swains Farm), Small Hills Road, Leigh, Reigate, RH2 8RQ, following an open market campaign. The asset is offered with full vacant possession with Surrey County Council (The Council) accepting, as part of the transaction, a part surrender of the current headlease held over the asset by Halsey Garton Residential Ltd (HGR).

This report seeks approval from the Cabinet Member for Property, Waste and Infrastructure, in conjunction with the Leader and Deputy Leader to:

 

i)             confirm surplus declarations on a specific set of assets to facilitate their earliest disposal by auction, and

ii)            to delegate authority to the S151 Officer consultation with the Director of Land and Property to secure best value from their release and to agree “auction reserve prices” - minimum acceptable price for assets.

1.    Declared the assets, outlined in this Report, as formally surplus to operational requirements (and agreed same in conjunction with the Leader and Deputy Leader).

 

2.    Delegated authority to the Section 151 Officer in consultation with the Director of Land & Property in consultation Executive Director – Environment, Infrastructure and Growth to secure best value from the assets released.

 

3.    Delegated further authority to those officers to agree minimum reserve prices, any specific covenants on the sale of assets to be sold through auction, to finalise each transaction, and enter into all associated legal contracts (including private treaty if assets can be sold prior to auction).
