    Recommendation: That under Section 100(A) of the Local Government Act 1972, the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information under the relevant paragraphs of Part 1 of Schedule 12A of the Act.

DISABILITY CHALLENGERS, ST JAMES’ AVENUE, FARNHAM – SECURING AN OVERAGE RECEIPT

    In 2005, Surrey County Council sold a former school site in St James’ Drive, Farnham to Disability Challengers on an unconditional basis.

     

    In April 2018, Surrey County Council secured a substantial overage capital receipt as a result of a part disposal of a part of the property, as it benefitted from the provisions of an Overage Deed entered into at the time of the disposal to Disability Challengers.

     

    This report summarises the background to the engagement held between Disability Challengers and Surrey County Council during their sale process, which generated the overage payment.

     

    In recognition of the costs incurred by Disability Challengers in undertaking additional feasibility and viability studies as a result of that consultation and eventual sale, Surrey County Council has been asked to make a contribution to the substantial legal and other professional team costs incurred. 

     

    Decision:

    RESOLVED:

     

    It was agreed that:

     

    1.            Surrey County Council approves payment of the amount as set out in the Part 2 report as a contribution towards Disability Challengers costs in connection with the preparation and sale of part of the land

    2.            Surrey County Council delegates to the Chief Property Officer, in consultation with the Member for Property & Business Services, the ability to enter into an appropriate update of the Overage Deed, in connection with any subsequent disposal of land retained by Disability Challenge such that it is fair and equitable to both parties.
